These Terms of Service (“Terms”) govern your use of Shifty Gypsy Tattoo’s services, including
in-studio tattoo services, communication with our artists, and any related online forms,
booking pages, or communications (“Services”). By booking an appointment, visiting the studio,
or receiving a tattoo from Shifty Gypsy Tattoo (“Shifty Gypsy,” “we,” “us,” or “our”), you
agree to these Terms.

2. Eligibility and Age Requirements
- You must be at least 18 years old to receive tattoo services from Shifty Gypsy Tattoo.
- You must present a valid, government-issued photo ID to verify your age.

If any services are ever offered to minors in the future, additional parent/guardian
documentation and consent will be required as permitted by applicable law. For current
policies, please verify directly with the shop.
3. Health, Consent, and Waivers

Before receiving any tattoo, you will be required to complete and sign an in-studio consent
and health form. You must answer all questions honestly and completely.

By signing, you confirm that you are in suitable health to receive a tattoo and that you
understand the potential risks (including, but not limited to, infection, allergic reaction,
scarring, and other complications).

You agree to follow any pre-care and aftercare instructions provided by your artist.

Shifty Gypsy Tattoo does not provide medical advice. If you have health concerns, you should
consult a medical professional before or after receiving a tattoo.
4. Booking, Deposits, and Payments

We may offer online or in-person booking options for appointments. Details such as deposit
amounts, scheduling rules, and pricing may vary by artist and will be communicated at the time
of booking.

Some appointments may require a deposit to secure your time slot. In many cases, deposits are
non-refundable or may be forfeited if you cancel late or do not show; specific deposit terms
will be explained to you when you book.

We use Square and/or other payment processors to accept payments. By paying with a card or
digital method, you agree to the applicable terms of the processor.

All prices are subject to change and may vary based on design complexity, placement, size,
and artist.

In-store gift cards may be available. Gift card rules (including expiration dates or usage
restrictions, if any) will be provided at the time of purchase and are generally valid
only for services or products at Shifty Gypsy Tattoo.
5. Rescheduling, Cancellations, and No-Shows

If you need to reschedule an appointment, we ask that you contact us at least
24 hours in advance whenever possible.

If you arrive more than 15 minutes late, this may be treated as a no-show,
and your appointment may need to be rescheduled. Any applicable deposit may be forfeited
at the artist’s or studio’s discretion.

Repeated last-minute cancellations or no-shows may result in refusal of future bookings.
6. Studio Rules and Refusal of Service
- No kids or minors are allowed in the studio unless they are the client receiving services.
- No alcohol or intoxication is allowed. If you appear under the influence of alcohol or drugs, service will be refused.

We reserve the right to refuse or discontinue service to anyone at our discretion, including
but not limited to situations involving:
- Intoxication or substance use
- Abusive, threatening, or inappropriate behavior
- Hygiene or health concerns
- Requests for hateful, discriminatory, or otherwise inappropriate content

If service is refused or discontinued due to violation of these rules, any deposit may be
forfeited.
7. Artwork, Designs, and Intellectual Property

Tattoo designs created by Shifty Gypsy Tattoo and its artists are considered artistic works.
The artist typically retains copyright and intellectual property rights in the artwork.

You have the right to wear the tattoo on your body, but you do not automatically gain rights
to reproduce the artwork for commercial purposes (such as logos, merchandise, or branding)
without written permission from the artist and/or the studio.

Custom designs are generally intended for the specific client who commissioned them. Artists
reserve the right to decide whether similar or derivative designs may be used for other
clients.

You may not copy, reproduce, or distribute the design in any form (including digital or
printed copies) for commercial use without explicit written permission.
8. Touch-Ups

Touch-up policies may vary by artist and by tattoo. Some artists may offer a complimentary
or discounted touch-up within a certain time frame, while others may charge a fee.

Eligibility for touch-ups may depend on whether you followed the aftercare instructions, the
placement and type of tattoo, and how the tattoo has healed.

Your artist will explain any touch-up options, conditions, and time windows applicable to
your tattoo. Please discuss this directly with your artist at the time of service.
9. Photos, Portfolio Use, and Social Media

We may photograph your tattoo for our records and portfolio. These images may be used on our
website, social media accounts, printed materials, or other marketing and promotional
channels related to Shifty Gypsy Tattoo.

We typically focus on the tattooed area and do not include faces unless the tattoo is on the
face or requires facial context.

By receiving services from us, you understand that we may photograph and use images of your
tattoo for shop-related purposes unless you request otherwise. If you do not
want your tattoo photographed or posted, inform your artist or contact the shop, and we will
respect your request.
10. Risks, Aftercare, and No Medical Advice

Tattoos carry inherent risks, including but not limited to: infection, allergic reaction,
scarring, skin irritation, ink spreading (“blowout”), and other complications.

Your artist will provide general aftercare instructions. It is your responsibility to follow
these instructions carefully.

Shifty Gypsy Tattoo is not responsible for problems that arise from failing to follow
aftercare instructions or from personal health conditions, lifestyle, or environmental
factors outside our control.

Results vary based on factors such as skin type, placement, size, color choices, aftercare,
and personal lifestyle (e.g., sun exposure, skincare routines).

We do not provide medical advice. If you experience unusual symptoms or suspect a medical
issue, you should contact a medical professional immediately.
11. Text Messages, Email, and Communications

With your consent, we may send you text messages and/or emails related to your appointments
(such as confirmations, reminders, and updates), as well as promotional messages about
specials, events, or shop announcements.

Message frequency may vary. Message and data rates may apply.

You can opt out of marketing texts at any time by replying STOP and can opt
out of marketing emails by clicking “unsubscribe.” You may still receive important
transactional communications as permitted by law.
- Consent is not a condition of purchase or service.
12. Limitation of Liability
To the fullest extent permitted by law, Shifty Gypsy Tattoo and its owners, employees, and
artists are not liable for any indirect, incidental, special, or consequential damages arising
out of or related to your tattoo, including but not limited to infections, allergic reactions,
scarring, or dissatisfaction with the appearance of the tattoo.
In any case, our total liability for any claim related to the Services will be limited to the
amount you paid for the specific service giving rise to the claim.
13. Indemnification
You agree to indemnify and hold harmless Shifty Gypsy Tattoo, its owners, employees, and
artists from and against any claims, damages, liabilities, costs, and expenses (including
reasonable attorney fees) arising out of or related to: (a) your breach of these Terms;
(b) your failure to follow aftercare instructions; or (c) your misuse of any of our Services.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Arkansas,
without regard to its conflict of law principles. Any disputes will be handled in the
appropriate courts located in or for Faulkner County, Arkansas, unless otherwise required by law.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date
at the top of this page. Your continued use of our Services after any changes means you accept
the updated Terms.
